Experts Provide Value in Damages Litigation

Hiring a qualified damages expert can be a key factor in the outcome of litigation. Damages experts provide accomplished opinions on the appropriate amount of damages suffered by a party in litigation. These opinions are meant to assist the judge and jury in understanding the facts and evidence of the case in order to render an appropriate verdict. Qualified damages experts successfully accomplish this by effectively communicating their opinions in a report and/or through testimony.

The importance of an effective damages expert was highlighted in the recent case, Lucent Technologies, Inc. v. Gateway, Inc. In this case, the appellate court overturned the jury’s $358 million verdict, in part because the plaintiff’s expert did not provide sufficient evidence supporting his final conclusion.

A damages expert’s main focus is providing and communicating a professional opinion on damages, however, the expert can also provide other valuable services to attorneys. The damages expert can assist with discovery, preparing attorneys for depositions with key witnesses, critiquing opposing experts’ reports and analyses, and assisting in negotiations.
